GENERAL CONDITIONS OF SALE

For all information, questions, and order follow-up, our Customer Service is at your disposal by e-mail contact@domainedeleos.com Any order placed on our website www.domainedeleos.com implies the express and unreserved acceptance of these general terms of sale, which constitute an essential element of the contract and of our agreement, both for you as the buyer and for us as the seller. Alcohol abuse is dangerous for your health. Drink in moderation. Ordinance no. 59-107 of 7 January 1959 and Law no. 74-631 of 5 July 1974 prohibit the sale and offer of alcoholic beverages to minors and similar persons. Consequently, by filling in your Order Form, you acknowledge that you have the legal capacity to conclude this contract.

1 – PAYMENT

To pay for your order: Credit cards such as Visa, Carte Bleue, MasterCard and American Express will be automatically debited after validation of the order. Your order is processed immediately. Security: By validating the order form, you guarantee that you have the necessary authorisations to use the method of payment that you have chosen. We certify that credit card details are encrypted and never transmitted in clear text on the network. Full payment: the principle Payment is due in full; from the moment the order is placed. The amounts collected cannot be considered as a deposit. An order will be considered complete when all products have been shipped and you have paid in full for the products and your share of the shipping costs. Incomplete payment: what effects? We shall have the right to refuse to make a delivery or to honour an order in cases where you have not paid in full or in part for a previous order, or in cases where a payment dispute remains. We retain full ownership of the products on sale until full payment of all sums due in respect of your order (including costs and taxes) has been received. However, from the moment you receive the goods, the risk is transferred to you. You must therefore ensure that the goods are well preserved.

2 – DELIVERY

The delivery costs are in addition to the selling price of the articles. The modes of transport The products will be delivered to the address that you will have indicated on the order form. Depending on the weight and/or volume of the various products ordered, SAS LEOS will choose the most suitable carrier for your goods. Delivery times The applicable delivery times are those indicated when you validate your order. Please note, however, that any order paid by cheque will only be processed on receipt of the balance. Availability and shipping times must be recalculated from the date of registration of this method of payment. Generally, orders are dispatched within 2 to 7 working days. In the event of a delay in delivery by the carriers, we invite you to report this delay by contacting us at contact@domainedeleos.com. We will open an investigation with the carrier concerned in order to obtain the location of the package. If the goods are found, they will be sent back to your home as soon as possible. If not, and after obtaining a loss report from the carrier, we will reship the product(s) or, in the event of definitive unavailability, we will reimburse you the sums collected in accordance with the terms of these general conditions of sale. For all orders over or equal to 150 euros including VAT, shipping costs are free for delivery in metropolitan France.

3 – THE RECEPTION

The person receiving the parcel, the care to be taken? Be careful, if you entrust the reception of the product to a third party (caretaker of your building, receptionist at the workplace, …) he/she receives the parcel in your name and on your behalf. You should therefore ask them to be vigilant about following the usual precautions and remind them to take the same care with the item received as if they were the personal recipient. Initial verification: what precautions should be taken? We invite you to check (or have the receiving agent check) the apparent condition of the products on delivery. In the event of an apparent anomaly (damage, missing product compared to the delivery note, damaged package, broken products, etc.) we invite you to report it within 3 days by registered letter with acknowledgement of receipt. In the event of any problem upon receipt, it is essential that you keep the items in the condition in which they were delivered (including accessories, instructions, packaging and overpackaging). If the products need to be returned, you should submit a request for return by simple letter addressed to SAS LEOS – 66 avenue des Champs-Elysées 75008 Paris. This request must be accompanied, if necessary, by a copy of the letter sent to the carrier or the “spoliation report” or the “anomaly report” obtained from the carrier. You notice an anomaly or spoliation: how to react? In the case of a delivery made by the Post Office, if the parcel arrives open and/or damaged (in particular with the presence of the yellow “La Poste” tape) you can either accept it or refuse it. If you or your representative decide to accept the goods, you must be careful to – to write “handwritten reservations” by having the postman sign next to it and – to fill in a “statement of anomaly” at the same time as stipulated by the regulations of the Post Office. This form should be sent to us so that we can open an investigation and start a compensation procedure, if necessary. If you or your representative prefer to refuse the goods, in addition to the “handwritten reservations” to be issued, you must ask the carrier to return the package to us, accompanied by a “spoliation report” (report 170). As a precaution, we advise you to keep a copy of this form. In the case of deliveries made by other carriers, whether or not you accept the delivery, for any opened and/or damaged parcel, you must make “handwritten reservations” that you will notify on the delivery slip and of which you will inform us by mail, as well as the carrier, within three (3) working days following the delivery. Some carriers may carry out a home inspection to check the condition of the delivered parcel before collection and, if necessary, the parcel(s) will be redirected “return to sender” to our after-sales service, together with a notification of incidence. You notice a delivery error: what should you do? Wrong addressee. In the event that you receive a delivery that is not intended for you, we ask you to keep the package as is and to inform our customer service department immediately at contact@domainedeleos.com Products delivered not in conformity with the order: In case of non-conforming products, we invite you to make your complaints to our customer service at contact@domainedeleos.com. You will be asked to describe precisely the reasons for the non-conformity.

4 – RETURNS

All product returns must be requested by e-mail to the customer service department: contact@domainedeleos.com SAS LEOS does not accept any return of goods without prior agreement. In case of agreement, the goods will be taken back with a reduction of at least 25% of the invoice value.

5 – PRICES AND PRODUCT INFORMATION

The prices displayed include all taxes. Prices are subject to change at any time, depending on the pricing policy of manufacturers, wholesalers, and distributors. Under no circumstances may they be the subject of a request for application in shop (and vice versa). The photographs, texts, graphics and technical data sheets are for the most part taken from the documentation produced by the manufacturers or constructors, reproduced under their control and with their agreement. The characteristics of the products offered for sale and the photographs are not contractual. SAS LEOS cannot be held responsible for any errors that may have been introduced. SAS LEOS reserves the right to make changes without notice.

6 – AVAILABILITY

Our products are delivered on average within 2 to 7 working days (subject to availability in stock). Validation of order status When your order is validated, you will receive a confirmation by e-mail indicating the status of “New Order”. Once edited by our services, the status of your order is changed to “In preparation”. On average, we deliver within 2 to 7 working days.

7 – CONSERVATION

Our products must be kept in normal storage conditions (premises with suitable temperature and hygrometry). The seller cannot therefore be held responsible for the poor evolution of the products due to unsuitable storage conditions.

8 – WITHDRAWAL

The duration of the right of withdrawal: how long does it take? We grant you a 14-day withdrawal period to return, at your expense, products that do not suit you. This period runs from the day after you receive the product. Once this period has expired, you no longer have the right of withdrawal. How to exercise the right of withdrawal? To ensure the proper management of returns, we invite you to notify our customer service of your return in advance and to follow the instructions in article 4 – returns. In the event of exercising the right of withdrawal, you may request either a refund of the sums collected, or an exchange of an amount equivalent to the sums paid or, where appropriate, with a bank supplement. This right of withdrawal is exercised without penalty. However, the cost of the perfect return remains at your expense. You must ensure that the order for which you are withdrawing is returned complete, under the conditions mentioned in Article 4 – Returns.

9 – TAXES

For all purchases destined for France and European Community countries, your order will be subject to VAT, and prices will therefore be indicated in Euros, including VAT. Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and taxes, if any, related to the delivery of an item are the responsibility of the customer. SAS LEOS is not obliged to check and inform the customer of the applicable customs duties and taxes. To find out about these, the customer should contact the competent authorities in his country.

10 – PRODUCT INFORMATION

The prices of the products sold on the site are indicated in Euros and are given subject to obvious typographical errors. Should an error occur, SAS LEOS will contact the Customer to inform them of the error made by its services and will remind them that the Order will be invoiced under the corrected conditions. However, if the corrected conditions are not accepted, the Client will be free to cancel the corrected order without penalty.

11 – CONFIDENTIALITY

You are led to communicate personal information to us by subscribing to our newsletter or by filling in forms for online purchases. The information you send us is for the exclusive use of SAS LEOS. contact@domainedeleos.com undertakes not to pass on to third parties the personal information that Internet users provide on its site. This information is confidential. contact@domainedeleos.com undertakes to answer your questions about the data processing that we carry out. In accordance with article 34 of the law N°78-17 of January 6, 1978 relating to data processing, files and freedoms, you have a right of access, rectification and opposition to the personal data concerning you. Duration of storage of your data If you leave a comment, the comment and its metadata are kept indefinitely. This allows subsequent comments to be automatically recognised and approved instead of being left in the moderation queue. For users who register on our site (if possible), we also store the personal data indicated in their profile. All users can view, edit or delete their personal information at any time (with the exception of their username). Site managers can also view and modify this information. If you have an account or have left comments on the site, you can request to receive a file containing all the personal data we hold about you, including that which you have provided to us. You may also request the deletion of your personal data. This does not include data stored for administrative, legal or security purposes.
